Terms and Conditions

Terms and Conditions for the purchase of hardware, software and services from i-Layer and i-Layer Assist.

  1. The customer shall be responsible to i-Layer for ensuring the accuracy of the terms of any order.

  2. The withdrawal or cancellation of any order can only take place by means of letter, fax or email of an Authorised Representative of i-Layer.

  3. Prices and availability provided to the customer are only an invitation to treat, and are subject to change without notice.

  4. An order placed on 'backorder' is irrevocable.

  5. Prices are quoted exclusive of Value Added Tax.

  6. Invoices for goods will be dated the day of dispatch of the products and are payable on the date of dispatch, unless otherwise agreed.

  7. Invoices for services provided will be issued dated the day of provision and are payable on this date, unless otherwise agreed.

  8. Unless the customer has notified i-Layer in writing within 5 working days of the date of i-Layer's invoice that the product has not been delivered then delivery shall be deemed to have taken place and the Customer shall not be entitled to raise any claim of short- or mis-shipment.

  9. Any dates quoted for delivery of Products are approximate only and i-Layer shall not be liable for any delay in delivery of the products howsoever caused.

  10. Partial delivery is allowed unless mutually agreed by both parties.

  11. Risk of damage or loss of Products shall pass to the customer at the time of delivery.

  12. Ownership of the products shall not pass to the customer until i-Layer has received in full the price of the products and all other Products and Services previously sold or supplied by i-Layer to the customer for which payment is then due.

  13. i-Layer will accept liability for defective products only to the extent that i-Layer is entitled to make a claim under the manufacturers or publisher's Dead on Arrival, warranty or other defective goods terms and actually obtains from the manufacturer or publisher a refund credit repair or replacement in respect of the defective Products.

  14. i-Layer shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions or failure to follow i-Layer's or the manufacturer's or the publisher's instructions (whether oral or in writing) misuse or repair of the products without i-Layer's approval.

  15. If the total price of the products has not been paid no liability shall be accepted by i-Layer.

  16. The customer shall notify i-Layer within 48 hours of delivery discrepancies.

  17. If i-Layer has agreed to accept the return of Products, they must be returned in their original unopened packaging (except for warranty or dead on arrival returns). 

  18. Any temporary reduction of or interruption to i-Layers ability to carry out any services or part thereof shall not entitle the Client to suspend even temporarily any payment already due or for services already rendered.

  19. No service provided by i-Layer, i-Layer Assist and associated companies is guaranteed to be virus or error-free.

  20. It is the responsibility of the client to ensure the timely backup of data, and to ensure that these backups are error free.

  21. Clients are encouraged to consider cyber, data and/or business interruption insurance cover.

  22. Time spent in product research is chargable.

  23. Our calls may be recorded for quality control or training purposes.
